GoSumsel – Dalam sidang yang digelar di Pengadilan Negeri Palembang Klas 1A Khusus, dengan agenda pembacaan putusan (Vonis) oleh majelis hakim yang diketuai Hakim Adi Prasetyo SH MH.
Terdakwa Harun (49) warga Jl Pasar Pagi Betung, Zaini (40) warga Jl Kebun Jeruk Rimba Betung serta dua warga Jl Raya Palembang Betung bernama Agus Pinus (31) dan Robiansyah (27), terjerat dalam
pengangkut Bahan Bakar Minyak (BBM) ilegal tanpa izin sebanyak 10.000 liter. Oleh Majelis Hakim, ke empat terdakwa tersebut, divonis ringan dengan pidana kurungan hanya 9 bulan.
Dalam petikan amar putusan yang dibacakan, para terdakwa secara sah, dan meyakinkan melakukan perbuatan melawan hukum, sebagaimana dalam surat dakwaan pertama, melanggar pasal 53 huruf b UU no 22 tahun 2001, tentang migas Jo pasal 55 ayat (1) ke 1 KUHP.
“Mengadili dan memutuskan terhadp para terdakwa terbukti secara sah secara bersama-sama melakukan pengangkutan Minyak Mentah jenis solar olahan tanpa izin pengangkutan sebanyak 10.000 Liter dengan pidana masing-masing selama 9 bulan penjara,”ucap majelis hakim bacakan amar putusan, Kamis (6/2)
Selain menjatuhkan pidana penjara selama 9 bulan, majelis hakim juga menetapkan denda kepada para terdakwa sebesar Rp 1 Miliar yang apabila tidak dibayarkan diganti dengan pidana kurungan selama 6 bulan kurungan.
Terhadap amar putusan yang dibacakan tersebut, keempat terdakwa langsung menerima putusan tersebut yang sedikit lebih ringan dibandingkan dengan tuntutan Jaksa Penuntut Umum (JPU) Kejati Sumsel Murni SH yang menuntut terdakwa dengan pidana kurungan selama 1 tahun.(gS3)
